Arbitration in Florida Property Insurance Claims

An arbitration provision can change how a property-insurance dispute is resolved. Read the actual endorsement and signed election before assuming arbitration is required, optional or equivalent to appraisal.

Florida requires more than a sentence in a policy

Section 627.70154, Florida Statutes, permits mandatory binding arbitration in a Florida property policy only when all specified conditions apply:

  • A separate arbitration endorsement is attached.
  • The premium includes an actuarially sound credit or discount.
  • The policyholder signs an election disclosing surrendered rights, including jury trial.
  • The endorsement requires the insurer to comply with the statutory mediation provisions before arbitration.
  • The insurer also offers a policy without mandatory arbitration.

The provision was enacted in 2022. It did not require every Florida property claim to go through arbitration. An attorney should evaluate the documents, enforceability and rights in your particular dispute.

Appraisal, mediation and arbitration are different

Appraisal generally addresses the amount of loss under a policy’s appraisal clause. Mediation uses a neutral person to help the parties negotiate; a resulting signed settlement can have binding consequences. Arbitration may place a broader dispute before an arbitrator under an applicable agreement and law. Availability, scope and cost depend on the governing terms.

Read our Florida appraisal and mediation guide. Do not assume arbitration will be faster, cheaper or produce a better result. Do not sign an election, settlement or release without understanding its effect.

Documents to take to a legal consultation

  • The full policy and every endorsement, including the arbitration endorsement.
  • The signed election and documents showing the offered coverage choices.
  • Premium records and the identified credit or discount.
  • The insurer’s coverage position and any arbitration or mediation notices.
  • The claim chronology, estimates, payments and outstanding information requests.
  • Any response deadline stated in a notice.

Provide the actual documents rather than relying on a summary from a salesperson, adjuster or online article. A lawyer can explain legal rights, procedural choices, costs and any available challenge or review. Keep claim duties and response dates on a separate calendar while seeking advice.
