Florida Hail Damage Claims: Roof Evidence and Current Repair Rules

Updated November 2, 2026. General claim information and public-adjuster commentary. Policy dates, loss facts and later legal developments can change the answer. A Florida attorney should advise on legal rights, deadlines and litigation.

After a hailstorm, the important question is what damage the event caused to your property. Dents, granule loss and staining need professional interpretation; their presence alone does not establish that every roof component requires replacement.

Document the event and the property safely

Record the date, photographs taken from safe locations and the rooms or exterior areas affected. Save emergency repair invoices and reports. A qualified inspection can compare roof findings with gutters, flashing, screens, skylights and other components, while distinguishing event-related damage from wear or unrelated conditions. Do not climb onto a damaged roof.

The 25% rule was changed, not universally eliminated

SB 4-D created the section 553.844(5) exception for qualifying roofing systems and sections in May 2022. The result depends on code compliance and the proposed work. It does not mean that every hail claim requires a new roof, or that every roof can safely be patched. See our full roof-rule guide.

Build a supported repair estimate

The estimate should identify damage locations, quantities, appropriate materials and supported code requirements. Where tile availability, matching or repairability is disputed, obtain a specific written explanation and relevant evidence. Compare the proposed scope with the full policy, including deductibles, exclusions, roof-payment provisions and ordinance-or-law coverage.

If the insurer’s estimate seems incomplete

Request the reasons for omitted work in writing. Gather photographs, contractor observations and the insurer’s estimate before a claim review. Experienced Public Adjusters helps owners present documented damage and negotiate within the policy; no inspection or test guarantees a particular settlement.
